Conduct Prohibited Under this Policy

Abusive and Discriminatory Conduct

Discrimination: Acts of prejudice or discrimination based on race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, or any other legally protected characteristic.
Harassment: Unwelcome verbal, written, or physical conduct that demeans, intimidates, or creates a hostile environment. This includes, but is not limited to, offensive comments, inappropriate jokes, or unwanted physical contact.
Verbal and Physical Abuse: The use of derogatory, inflammatory, threatening, or abusive language. Any act of physical violence, assault, battery, or threat of harm is prohibited and will be reported to local authorities.
Intimidation: Behavior intended to coerce, frighten, or deter any individual from performing their duties or enjoying their experience.

Safety, Health, and Operational Infractions

Non-Compliance with Instructions: Refusal to follow the directions, safety warnings, and itinerary instructions issued by authorized CrossoverPeru guides or representatives, particularly regarding high-altitude acclimatization, site regulations, or emergency procedures.
Endangerment of Self or Others: Engaging in reckless or dangerous activities that pose a risk to the client’s own health or the safety of others. This includes venturing off marked paths in protected areas or ignoring warnings about dangerous terrain.
Use of Illegal Substances: The possession, consumption, or distribution of illegal drugs or controlled substances is strictly forbidden and subject to local law enforcement procedures.
Excessive Intoxication: Consumption of alcohol or use of legal substances that leads to severe intoxication, incapacitation, or disruptive behavior affecting the operations of the tour or the comfort of other travelers.

Damage, Vandalism, and Respect for Cultural Heritage

Vandalism and Damage: Any intentional or negligent act leading to the damage, defacement, or destruction of property belonging to CrossoverPeru (e.g., transport vehicles, equipment), hotels, or third-party service providers.
Disrespect for Heritage Sites: Touching, leaning on, climbing, or attempting to remove artifacts or stones from protected archaeological and historical sites, including but not limited to Machu Picchu, Sacsayhuamán, and other sites in the Sacred Valley.
Environmental Degradation: Littering, unauthorized feeding of wildlife, or any action that degrades the fragile natural environment of the tour destinations.
Unauthorized Access: Trespassing or entering restricted areas at accommodation, transport hubs, or archaeological sites without explicit permission.

Disruptive and Unlawful Behavior

Disruptive Conduct: Behavior that significantly interferes with the comfort, convenience, or well-being of other passengers, including excessive noise, persistent arguments, or monopolizing staff attention to the detriment of others.
Violation of Laws: Engaging in any activity that violates the national, regional, or local laws and regulations of Peru.
Theft: Any act of stealing or attempting to steal property belonging to other clients, staff, or local entities.

Consequences of Policy Violation

Immediate Termination of Services: The client may be immediately removed from the tour and denied further services without any right to a refund for the unused portion of the package.
Financial Responsibility: The client will be held financially responsible for any damages to property caused by their conduct.
Reporting to Authorities: Depending on the severity of the infraction, CrossoverPeru will report the incident to the appropriate local law enforcement or regulatory authorities.
