Terms of Use

These Terms of Use govern your access to and use of the CrossoverPeru website (www.crossoverperu.com.pe), and the services, information, content, and materials provided by CrossoverPeru. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Site.

Use of the Site and Services

A. Eligibility

By using the Site, you represent and warrant that you are at least eighteen (18) years of age and possess the legal authority to enter into this agreement and to use the Site in accordance with all terms and conditions herein.

B. Permitted Use

You are granted a limited, non-transferable, non-exclusive license to access and use the Site solely for personal and non-commercial purposes, which include:

Gathering information about our tours and services (Cusco and Southern Peru).

Booking reservations and making legitimate inquiries.

Accessing travel-related information provided by CrossoverPeru.

C. Prohibited Use

You agree not to use the Site for any purpose that is unlawful or prohibited by these Terms. Prohibited activities include:

Unauthorized Access: Attempting to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site.

Misrepresentation: Making any speculative, false, or fraudulent reservations or bookings, or any reservations in anticipation of demand.

Data Harvesting: Using automated means (such as spiders, robots, scrapers, or deep-links) to access, copy, or monitor any portion of the Site or any Content.

Distribution: Distributing, exchanging, modifying, selling, or transmitting anything from the Site, including but not limited to any text, images, audio, and video, for any business, commercial, or public purpose.

Intellectual Property Rights

A. Ownership

All content on the Site, including text, graphics, logos, images, software, and the compilation thereof (the “Content”), is the property of CrossoverPeru or its content suppliers and is protected by intellectual property laws.

B. Trademarks

The name CrossoverPeru and all related names, logos, product and service names, designs, and slogans are trademarks of CrossoverPeru or its affiliates. You must not use such marks without the prior written permission of CrossoverPeru.

Bookings, Payments, and Cancellations

A. Tour Pricing

Prices for tours and services are subject to change without notice and are not guaranteed until a booking confirmation is issued. All prices are listed in the currency specified on the Site.

B. Payment

Full payment or a required deposit must be received by the specified deadline. Failure to meet payment deadlines may result in the automatic cancellation of the reservation.

C. Contractual Agreement

All bookings made through the Site are subject to our specific Booking Conditions and Cancellation Policy, which are incorporated herein by reference. In the event of a conflict between these Terms of Use and the specific Booking Conditions, the Booking Conditions shall prevail.

Disclaimers and Limitation of Liability

A. Disclaimers

The Site and all Content are provided on an “as is” and “as available” basis. CrossoverPeru does not warrant that the functions contained on the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components.

B. Limitation of Liability

In no event shall CrossoverPeru, its affiliates, directors, employees, or agents be liable for any indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, your access to, display of, or use of the Site or with the delay or inability to access, display, or use the Site.

Governing Law and Jurisdiction

These Terms of Use and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the laws of Peru, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms shall be instituted exclusively in the courts of Cusco, Peru.
